IS YOUR VEHICLE A LEMON?

The rules of lemon law may differ from state to state. At Braff Injury Law Practice, we know that in general, your vehicle will qualify to be a lemon if:

  • It has been out of service for repair for 30 days or longer
  • It continues to have a defect within the warranty period even though the manufacturer or the authorized dealer has tried to repair the vehicle multiple times (at least three times)

If your vehicle meets either of these features, then it qualifies to be a lemon. However, it is prudent to consult with us before planning to file a lemon law claim. The leased vehicles are also covered by California’s Lemon law. However, the leased vehicles have to be:

  • Purchased from an authorized dealer
  • Under manufacturer’s warranty or dealer’s warranty

You cannot file a lemon law claim if a vehicle is no longer covered by manufacturer’s warranty or dealer’s warranty. Therefore, it is prudent to contact us as soon as possible after finding out that the leased vehicle has defects which cannot be repaired despite multiple attempts.

Under California’s Lemon law, the owner or lessee of a lemon vehicle:

  • Will receive a new vehicle as a replacement for the defective vehicle
  • Will receive a refund from the vehicle manufacturer once they repurchase the vehicle

  • The lemon claims are usually resolved through informal methods of dispute resolution. However, we do not accept unfair settlement offer from a vehicle’s manufacturer. If necessary, we will file a lawsuit against a manufacturer to recover sufficient compensation for you.
  • Once you contact the Braff Injury Law Practice over the phone or through our website, we will request you fill out a ‘case evaluation’ form. This form is available on our website. We will contact you as soon as we can determine your legal rights as a consumer under the state law (Song-Beverly Consumer Warranty Act) or federal law (Magnuson-Moss Warranty Act).
